You may have a strong case if any of the following apply:

  • You were tricked into transferring money from your bank account to a fraudster
  • You reported the fraud to your bank but were refused a refund
  • The fraud occurred after 7 October 2024 (mandatory reimbursement applies)
  • For pre-October 2024 fraud: your bank failed to apply adequate fraud warnings or Confirmation of Payee checks
  • Your bank failed to flag an unusual or high-risk transaction

What Happened

Authorised Push Payment (APP) fraud occurs when you are deceived into authorising a bank transfer to a fraudster. Unlike card fraud, you initiate the payment yourself — which is why banks historically refused to refund victims. Common APP scams include impersonation of HMRC, police or your bank; investment scams where fraudsters promise high returns; romance scams; purchase scams; and 'safe account' scams where fraudsters convince you to move money. From 7 October 2024, the Payment Systems Regulator (PSR) introduced mandatory APP fraud reimbursement rules requiring banks and payment firms to reimburse victims up to £85,000 per claim, within 5 business days of a claim, unless the victim acted with gross negligence or deliberately. Both the sending and receiving bank share responsibility for the refund.

Why You May Be Owed Compensation

If you were not 'grossly negligent', you are entitled to full reimbursement up to £85,000 per claim under the PSR's October 2024 mandatory reimbursement rules. Where banks have refused or under-paid, the Financial Ombudsman Service routinely overturns those decisions. Pre-October 2024 claims are still recoverable under the Contingent Reimbursement Model and FCA duty-of-care principles, particularly where the bank failed Confirmation of Payee or high-risk transaction checks.

Who Is Liable?

  • Sending bank Your bank — 50% liable for reimbursement under the PSR rules, regardless of scam type.
  • Receiving bank The bank that received the fraudulent payment — also 50% liable under PSR mandatory reimbursement.
